The Will of Emma Hanks of Bourton-on-the-Water

made on 20th May 1839

and proved on 4th April 1840

 

I Emma Hanks of Bourton-on-the-Water in the County of Gloucester widow do revoke all Wills and Testamentary dispositions by me heretofore made and do make and publish this only for my last Will and Testament

 

I give and devise unto my son John Hanks all those my freehold closes of land called Slaughter Bridge Ground, Coppins Lake and Upper Ham with the tithes thereof containing together twenty acres or thereabouts with the barn and other buildings thereon situate in the said Parish of Bourton-on-the-Water to hold the same unto my said son and his assigns for his life without impeachment of waste and immediately after his decease

 

I give and devise the said several closes of land and other hereditaments to the use of my granddaughter Emma Hanks and her assigns during her life without impeachment of waste and after her decease

 

I give and devise the same closes and other hereditaments to the use of the child if only one and if more that one of all the children of my said granddaughter who shall attain the age of twenty one years if more than one in equal shares as tenants in common and to his her and their heirs and assigns forever and in case there shall not be any child or children of my said granddaughter or being such he she or they shall all die under the twenty one years

 

Then I give and devise the said closes lands and hereditaments to the use of my sister Mary Ann Collett and my brother-in-law The Reverend Thomas Coles in equal shares as tenants in common and to their respective heirs and assigns forever

 

I give and devise unto my said son John Hanks all those my freehold closes of land called The Coss Cousens Ground, Meeting House Ground and The Mill Ground containing together twenty acres or thereabouts and severally situate in the said Parish of Bourton-on-the-Water with their appurtenances to hold the same unto and to the use of my said son his heirs and assigns forever

 

I also give devise and bequeath unto my said son John Hanks all my ready money and monies in the funds household furniture plate linen china books and all the rest and residue of my estate and effects of in or to which I or any person or persons in trust for me shall at my decease be seized possessed or entitled in possession reversion remainder or expectancy with their respective rights members and appurtenances to hold the same unto my said son his heirs executors administrators and assigns according to the respective natures and qualities thereof for ever

 

And I appoint the said John Hanks sole Executor of this my Will in witness thereof I have to this my Will set my hand and seal the twentieth day of May in the year of Our Lord one thousand eight hundred and thirty nine

 

Emma Hanks signed sealed published and declared by the above named Emma Hanks the testatrix as and for her last Will and Testament in the presence of us who in her presence at her request and in the presence of each other hath hereunto subscribed our names as witnesses
